REFERENCE Manu Smriti XI - 27. 984 Passage - kaptanam vihitanam pasusomanam nityanam sanmasyah samvatsarah pasurnityam vasante somastesamasambhave dhanabhavadidosena niskrtyartham nityasyakarane yodovastanivrtyartham srute' sminnimitte 'nya karma samamananti tatra kecitsamuccayam manyante satyayyeka karyatve pramanabhedena vidhanatra tadayuktam tatha ca brahmahatya prayascitte sraule smarte ca svasabdena vikalpam vasatyabhinidvisvajiddhayam ceti | Translation Cmed hatithi on Ms XI -27) Mrx 1-27) 'Animal and Soma sacrifices' the compulsory ones. The six-monthly and yearly 'Animal sacrifices' are compulsory, as also the 'Soma sacrifice' every spring. In the event of the impossibility of the performance' of these, on account of the absence of the requisite wealth 'in expiation thereof', for the removal of the sin incurred by the omission of a compulsory rite. In connection with the occasion here referred to the Veda lays down other expiatory rites; and some people would combine these with what is here prescribed; their point being that, even though both the rites serve the same purpose, yet they are found to be laid down by two distinct authorities. This however, is not right, because in connection with the expiatory rites for the slaying of a Brahmana, our author is going to declare in so many words that between the rite laid down in the Veda and that prescribed in the Smrti, there should be option. 'He may perform the Abhijit or the Visvajit.'

Explanation - 985 1 While dealing with penances gift and sacrifices we get Manu Smriti XI-27 which says - "In case the prescribed animal and soma sacrifices cannot be performed, let him always offer at the change of the year a Vaisvanari Ishti as a penance (for omission)." Here question arises whether a man should go for expiation laid down in the Sruti and Smrti combinding or one of these, when a man could not perform Pashu and Soma sacrifices. Medhatithi on commenting on this stanza says that a man should go for expiation stated in the Sruti or in the Smrti and not combindly as stated by others. He further explains his stand-point giving example of staying of Brahmana and states authority that he may perform Abhijit or Visvajit. Visvajit. Here Medhatithi bent down on Vikalpa then the Samuccaya and refutes the opinion of others. Here Medhatithi records the view point of some commentators of Manu Smriti who hold that in performing Visvanar Isiti by way of an expiation a man shut should make a combination of all the details laid down in the Sruti and Sirti. Medhatithi, however, does not subscribe to this view and points out that the present text of Manu Smriti can be looked upon as a case of option only.
