REFERENCE Manu Smriti IV. 252. 8784 Passage- 1 pratividhvasya ca pratiprasavo bhavati | laukikya vyarthitaya praptih pratisiddha saiva pratiasuyate | Translation - (Medhatithi on OS V-252) No caste being specified, acceptance is permitted from righteous Sudras also, as is said under 223 - A Brahmana shall not eat, etc. etc. 1 Explanation 1 In the printed text of the Manusmrti with commentary of Medhatithi as edited by J.R. Gharpure and J.H.Dave, it is found that the passage under discussion is printed after the Manusmrti IV. 252. If the passage under_discussion is read as a commentary on the Manusmrti Iv. 252, then it appears abscured. The commentary further shows that it has, nothing to do with the explanation of the words occuring in the stanza No.252. Here the question arises as regards proper plan to be assigned to the passage under discussion. Unless the proper position of the passage is decided, the passage cannot be understood in its proper spirit. 1. gurusu tvabhyatitesu vina va tairgrhe vasan | atmano vrttimanvicchan grhani ya sadhutah sada ||4-252|| ms voi I P- 492
1785 1 In the edition of J.R.Gbarpure and J.H.Dave, the two stanzas are given as additional stanza possibly not found as commented upon by all the commentators of the Manusmrti except perhaps by Medhatithi and Ramac andra. Hence the learned editors have decided to include these stanzas in the foot-note and also as not forming the proper part of the Manusmrti as such. If however, the other stanzas in the Manusmrti are properly read, then it is possible for us to determine the exact position of the verses so treated as additional and also the place of the commentary of Medhatithi on such stanzas. 2 On a careful consideration of the other stanzas of the Manusmrti it will be proper on our part to read the stanzas 'Cikitsaka' and 'Na Vidyamaname va' etc. before the Manu Smriti 251. The passage 'Tatvayuktam Pratipras u-yate" under discussion will have to be read as a commentary on the stanzas. Manusmrti IV.251. This commentary 'Atra kascidaha' etc. is to be read as a separate paragraph after the expression 'Duskrta karma' where actually the commentary on the Manusmrti IV. 251 comes to an end. 8786 It is also possible to substantiate our arrangement by quoting the 1 commentary of Ramac andra on the stanzas 'Cikitsaka' etc. and 'Na vidyamanam eva' etc., which is particularly printed by J.H.Dave in his edition of the Manusmrti after IV. 249 on page 490. £ It is further interesting to note here that except Medhatithi and Ramacandra, the other commentators of Manusmrti are silent on their comments on these two additional stanzas. While discussing the persons from whom a competant Brahmana should not accept any gift or donation, we have in the Manusmrti the two additional stanza 'Cikitsaka' etc. 'Na vidyamanan evam' etc. From this it is evident that the competant Brahmana should not accept a gift from a physician, ungrateful ungreat fall person, artist, a person who borrows money at a low interest (vardusi), the eunuch, a lady who has defiled the good name of the family and also from a person who is wellknown as a pauper. These two stanzes will have to be regardee as forming the negative rule. The Manusmrti IV. 251, laid down that the lord of created beings (Prajapati) has declared that alms freely offered and brought by the person himself may be accepted even from a sinful person provided the gift has not been asked for or promised before hand. 1. 1 cikitsaketi | cikitsakadibhih udyatam bhiksyam varjayet | na vidheti | gandhadivyatirekena yadanyadravyam tasyapyanena visesana na grahyatvam | Ramacandro Ms voi II P-490
The Manusmrti IV. 251 will have to be regarded as an exception to the rule which is laid down by two additional stanzas quoted above. Here Manusmrti IV. 251 is an exception to the negative rule laid down by the two additional stanzas on the Manusmrti and hence this fit becomes a gift case of 'Pratiprasava' i.e. exception to the negative rules. 787
